"About 5 years ago my wife and I rented an apartment on a well known urbanisation here in Benahavis on the Costa Del Sol.The contract we signed was for 3 years with options to increase to 5 years. It was a 'rent to buy' contract with agreed sale price at the end of the contract. The owners were a well known Spanish Bank. About 6 months before the contract was due to end, and without any notification or explanation, we received a letter from the bank notifying us that we will not be given the option to buy at the end of the contract and we had to vacate the apartment on the exact day of termination, which in our case was the 18th.December 2021. We already had been in discussion with a company that arranged mortgages, Fluent Finance Abroad based in central San Pedro, headed by Marc Elliott de Lama. He advised us to seek legal advice and subsequently introduced us to Antonio HINOJOSA and Alicia ARAGONÉS of Hinojosa Abogados, also based in San Pedro. Following a series of consultations with Antonio, Alicia and Marc, we agreed to take action against the bank, who were well known in legal circles to be extremely difficult to deal with, and so it subsequently proved to be. During the following 2 years, and the service of eviction notices, court papers, several court hearings, and not to mention the at times intolerable stress, we won our case in court, and the bank reluctantly agreed to sell. the property to us. Through the entire legal process during these years, both Antonio and Alicia, ably supported by Marc on occasions, remained positive and supportive to us, not just on a professional level but also on a personal one ss well. There were quite a few moments during this period when both my wife and I nearly walked away from the process, as at times it seemed all the odds were stacked against us, and it was very difficult for us to remain positive. Antonio and Alicia were adamant that we would win our case and that we would be able to buy the apartment eventually. A couple of positive judgements in court thanks to excellent case management and presentation by Antonio and Alicia, eventually resulted in allowing us the opportunity to buy our apartment. We had won our case thanks to them. I cannot stress how brilliant Antonio and Alicia were at every step of the way throughout this tortuous process, regularly updating us with latest developments, and regularly meeting with us to discuss future strategy and 'tactics'. Alicia in particular took great pride in helping us with the volume of paperwork, and on occasions accompanying us to the various notary offices, The fact that we are now the proud owners of an apartment in Spain, is solely down to the extreme professionalism and expertise of both Antonio and Alicia, and I would have no hesitation whatsoever in recommending Hinojosa Abogados to any person needing serious legal professional advice, or even when considering buying a property in Spain.
